TERMS OF SERVICE
Terms of Service
Article 1 (Purpose)
These Terms set out the rights, obligations, and responsibilities of TK Media (the “Company”) and users, and other necessary matters, in connection with the use of the game and app services (the “Services”) that the Company provides under the FastMake brand.
Article 2 (Definitions)
- “Services” means the games, the digital content within app services (including educational content), and related additional services that the Company provides through its website (fastmake.net) and mobile apps.
- “User” means anyone who uses the Services in accordance with these Terms.
- “Member” means a user who has been given an account in an app; matters concerning the account are governed by the terms of service of that app.
- “Paid Content” means digital content that a user purchases for a fee, such as in-game currency, items, educational content, and access passes.
Article 3 (Posting and Amendment of the Terms)
- The Company posts these Terms on the initial screen of the Services or on a linked screen so that users can easily review them.
- The Company may amend these Terms to the extent that it does not violate applicable laws. When it does, it will announce the effective date and the reason for the amendment from 7 days before the effective date (30 days before for changes unfavorable to users).
- If a user continues to use the Services after the effective date of the amended Terms, the user is deemed to have agreed to them. A user who does not agree may terminate the usage agreement.
Article 4 (Usage Agreement and Accounts)
- The website (fastmake.net) does not provide sign-up or login features, and no separate membership registration is required to use the website or to make payments.
- When purchasing Paid Content on the website, the usage agreement is formed when the user agrees to these Terms and the Refund Policy and proceeds with payment.
- Some apps may provide account features. In that case, matters concerning sign-up, use, and withdrawal of the account are governed by that app’s terms of service and privacy policy.
- The Company may decline to accept a payment or may restrict use if a person has used another person’s information, entered false information, or has a history of use being restricted for violating laws or these Terms.
Article 5 (Provision and Change of the Services)
- As a rule, the Company provides the Services 24 hours a day, every day of the year. However, the Services may be temporarily suspended for unavoidable reasons such as system maintenance, failures, or natural disasters; where possible, the Company will announce this in advance.
- The Company may change the Services for operational or technical needs, and will announce significant changes in advance.
- Some Services (e.g., Stone Match) may not yet be released or may be in trial operation; in that case, the Services screen will indicate that they are coming soon.
Article 6 (Obligations of Users)
Users must not engage in any of the following.
- Using another person’s information, registering false information, or transferring, lending, or selling an account
- Hacking, using automated programs (macros, bots, etc.), manipulating scores or rankings by abnormal means, or interfering with the operation of the Services
- Infringing the copyright or other intellectual property rights of the Company or third parties, or copying or distributing the content of the Services without permission
- Defaming others or causing them discomfort, or acting contrary to laws and public order
Article 7 (Purchase and Payment of Paid Content)
- The name, description, price, period of use, and payment method of Paid Content are shown on the relevant screen before purchase.
- Users may pay by credit card, bank transfer, simple payment, or other payment methods offered by the Company. Payments are processed through an app marketplace (Apple App Store, Google Play, etc.) or, on the website, through PortOne (payment gateway: KG Inicis).
- If a minor made a payment without the consent of a legal guardian, the user or the legal guardian may cancel the payment.
Article 8 (Withdrawal and Refunds)
The withdrawal of purchases of Paid Content and the conditions, method, and timing of refunds are governed by the Refund Policy (in-app purchases through app marketplaces follow the refund policy and procedures of that platform), and nothing in these Terms limits the rights of users under applicable laws (the E-Commerce Act, the Content Industry Promotion Act, etc.).
Article 9 (Advertising)
The Company may display advertisements within the Services.
Article 10 (Copyright and License)
Copyright and intellectual property rights in the Services and the content within them belong to the Company or the rightful rights holders. The Company grants users a non-exclusive, non-transferable right to use the Services, and users may not use it for commercial purposes or provide it to third parties without the Company’s prior consent.
Article 11 (Termination and Restriction of Use)
- A Member may request account withdrawal (termination) at any time through the menu in the relevant app or by contacting customer support. Upon termination, Paid Content held may be extinguished, except as provided in the Refund Policy.
- If a user violates Article 6, the Company may restrict use of the Services or terminate the usage agreement after prior notice. In urgent cases, the Company may act first and notify afterward.
Article 12 (Disclaimer and Limitation of Liability)
- The Company is not liable for damages caused by reasons beyond its control, such as natural disasters, force majeure, causes attributable to the user, or communication failures.
- The Company bears liability, in accordance with applicable laws, for damages caused by its willful misconduct or gross negligence.
Article 13 (Dispute Resolution and Jurisdiction)
- The Company and users will endeavor to resolve disputes between them through mutual consultation.
- The laws of the Republic of Korea apply to disputes that cannot be resolved through consultation, and lawsuits shall be brought in the court with jurisdiction under the Civil Procedure Act.
